Matrimonial and Estate Matters

Apart from day-to-day preparation of Wills and Lasting Powers of Attorney and routine probate files, our lawyers represent clients in heavily contested, complex and high-value matrimonial and probate matters, which deal with novel issues of law.

We take a holistic approach in addressing not just legal issues but also the sensitivities that come with family members who disagree on matters.

WORK HIGHLIGHTS, representing:

  • The sole surviving executrix seeking declarations relating to a will which included a gift to a charity which ceased to exist. Novel issues included whether the gift was to be seen as a gift to a particular charitable corporation or as a gift for charitable purposes and, if the latter, whether the gift could therefore be vested in another charity which continued the same charitable purposes.
  • The estate in a Will Trust against a beneficiary on whether the gift (a property valued at S$7 million) was a valid charitable gift .
  • A co-owner of a property in a suit before the High Court against claims that the joint-owners hold 69.25% of the property on trust for the Plaintiff; alternatively that the Plaintiff be declared an equitable tenant-in-common of the property.
  • A defendant spouse against a plaintiff spouse in a heavily contested custody proceeding, where the defendant successfully obtained shared care and control of the children of the marriage.
  • A high net-worth Japanese expatriate against his spouse in divorce proceedings, wherein the former spouse sought maintenance of $50,000 per month for the child of the marriage alone, and a substantial proportion of the matrimonial assets.
